Using 70's Voice Over in New Music Track


Dear Rich: I'm in the final stages of producing a music single. In the song I've sampled the voice-over of a 1970's TV ad. The voice-over is of a familiar and famous figure from that period. Would I need to clear this and for this purpose with whom, as I assume in this case that no record company or music publisher would be involved. We're not sure which familiar and famous person's voice-over you're using but if you're creating a second single, you might want to consider a classic 70s TV ad in which a size-challenged nautical figure -- perhaps a descendant of this character -- rides around in a boat in your toilet and urges consumers to pollute the waters with blue chemicals. How '70s is that?
Right you had a question. You're correct that you wouldn't need to clear the voice-over recording with a music publisher or record company. You may not need any permission at all, as explained below, but there are three possible legal rights you need to consider:
  • the copyright on the commercial. The most likely permission needed is that of the copyright holder -- that's likely to be the ad agency that created the commercial, or the company whose product is featured in the commercial. The copyright owner would own rights to the text of the commercial and to the audio. You wouldn't need permission if you claimed fair use (which can always be a bit tricky). And you probably wouldn't need to bother with permission if the company holding copyright had disappeared and you couldn't track down a successor. (And of course, you wouldn't need permission if your song had limited appeal and was unlikely to be heard by anyone connected with the copyright owner -- what we call the "tree falls in the forest" theory.)
  • the use of the famous figure's voice.  If the familiar and famous person's (FFP) voice is recognizable and listeners think that it is being used for purposes of endorsement, the FFP might have a claim based on the right of publicity. We wouldn't worry about this too much because the FFP's ROP probably won't be triggered unless the song is used for a 3rd party commercial purpose -- that is, it's licensed for use with another product or service (This article provides a short ROP summary). 
  • trademark rights. If the product name (the subject of the commercial) is included in your song, that might trigger claims of dilution or infringement but both of these claims are unlikely to succeed as use of trademarks is permitted for informational (or editorial) uses such as songs. One judge characterized the conflicting interests of the parties "Speech-zilla v. Trademark Kong.



Hyundai Moves Up in the World with Times Square Billboard

Continuing its high-profile advertising initiatives this year which included the launch of its new Genesis Coupe during the Super Bowl coverage, Hyundai has moved into Times Square in Manhattan, New York with a new outdoor campaign. The cube shaped billboard has three display faces, the front of which has LED screens showing a continuously updated stream of Hyundai video content while the two other sides get vinyl banners.

"As one of the world's largest brands, Hyundai is actively looking for ways to integrate with the world's biggest advertising venues, such as the Super Bowl, Academy Awards and World Cup," said Chris Perry, director of Marketing Communications, Hyundai Motor America. "Times Square billboards draw 1.5 million impressions daily and it is one of the most iconic locations for outdoor advertising, so it aligns perfectly with our overall brand strategy."

The first of a series of ads to be placed on the Times Square billboard features the South Korean firm's new Genesis Coupe.




Two Better than One: Toyota Australia's New TV Ad on Hybrids Hits the Spot [With Video]

Toyota's Australian division is ramping up its advertising efforts on its hybrid synergy drive technology as the company is getting ready to introduce a total of eight new hybrid models to the market over the next four years, starting with the locally built Camry Hybrid in February 2010. To get the key message around, Toyota aired a new locally produced television commercial called "Better Together" that was created by Sydney advertising agency Saatchi and Saatchi.

There are no cars in the advertisement which shows a man with another version of himself standing behind and helping him around with his daily chores - just like an electric motor assists the gasoline engine in Toyota's hybrid models.

"The key message is 'Better Together' - that two things working together can achieve more than any one thing ever could," says Toyota Australia's senior executive director sales and marketing, David Buttner. "It is a metaphor for Hybrid Synergy Drive technology, which continues to improve, produce more power and use less fuel with fewer emissions," he said.

The Hybrid Synergy Drive 'Better Together' commercial went to air in Australia on the evening of Sunday, 25 October.

Real or Fake? Gran Turismo Ad Shows 1969 Corvette Stingray and 1988 Lamborghini Countach Scraping Sides

After watching this Japanese Gran Turismo PSP commercial of a '69 Corvette Stingray and a '88 Lamborghini Countach clashing sides on the race track more than a dozen times, we still can't tell if it's a real-life or a computer simulated scene. But then again, that's exactly what makes this commercial so successful in our opinion; for one, you'll want to watch it again and again but most importantly, it gets the message across that the video game blurs the lines of reality and fantasy. VIDEO: Spada Codatronca Prom Film Hints at Batmobile by.... Denying it

A little confused by our title? Well, don't blame us. Blame the advertising agency Kobayashi that came up with the idea of producing this animated promotional film for the Corvette-powered Spada Codatronca, a limited edition supercar created by former chief designer at Zagato and BMW, Ercole Spada. While the film is clearly inspired by the Batman comics, at the same time, it is noted that the city we're looking at isn't Gotham and the vehicle's isn't the Batmobile.

And the point is, we hear you ask? Well, apparently to show that the Spada Codatronca is something like the real-life Batmobile, or at least that's what we assume by looking at the film. If you want our opinion, unless the Codatronca's target audience are adolescent comic book readers, Kobayashi is barking down the wrong tree.







VIDEO: Lamborghini Reventon Roadster Promo Tells us What Are the Chances of Owning One

You would assume that anybody with basic math skills could probably figure out what the chances are of owing one of the 20 (more or less) Lamborghini Reventon Roadster models that are destined for production. However, we must say that this promotional film, which was created by the German agency Philipp und Keuntje for the Frankfurt Motor Show, somewhat confused us.

Bypassing all the other stats mentioned in the ad, it is claimed that the chances of owning the €1,1 million Italian special is 1 in 700,000,000.

Okay, so world's total population is approximately 6,8 billion (not that it matters, but we also learned that there are about 134 million babies born every year).

If we're not making a humiliating blunder, shouldn't it be 1 in 340,000,000? That is, unless Lamborghini is planning to limit total production of the topless Reventon to around 10 examples or the film is talking about the number of vehicles available for sale excluding those spoken for.

Well, either way, someone (yes that is me) spent way too much time on a promo film that to be completely honest, is nothing special, to say the least.




VIDEO: 2010 SAAB 9-5 Sedan Promo Film Plus Frankfurt Show Interview with Saab Boss

Saab has dropped an official promotional video of its 2009 Frankfurt Motor Show star, the all-new 9-5 sedan that will be heading our way sometime in early 2010. You can check it out after the break along with a second video that contains a short interview with Saab's managing director Jan Ake Jonsson. The latter talks about the firm's newest creation as well as the latest developments in the company and in particular about Beijing Automotive's interest in buying a minority stake in the firm that has agreed to buy Saab from GM, Swedish sports car maker Koenigsegg Group.





2011 Hyundai Sonata YF Video Galore with Presentation and Promotional Films

Yesterday, we brought you news and a high-resolution photo album of Hyundai's spanking new 2011 Sonata YF that was presented in its home market of South Korea. And now we have the first videos of the fancy-looking (at least for a mainstream model) mid-size sedan that marks a significant departure style-wise from the previous generations of the Sonata. Whereas the KDM model gets a 165HP 2.0-liter gasoline engine, the North American variant, which will be produced at Hyundai's plant in Alabama from early 2010, will be offered at launch with a 2.4-liter direct-injection four-cylinder unit.

VIDEO: New Cadillac Spot Previews Production CTS Coupe

General Motors has released a new 60-second spot for its Cadillac brand called "Re-ignition", which showcases the firm's forthcoming models including the CTS Sport Wagon, the new 2010 SRX crossover and most importantly, at the final segment of the clip, the production version of the CTS Coupe that is due to arrive in U.S. showrooms the summer of 2010.

We only get a quick glimpse of the two-door sports coupe, but from what we can tell, the vehicle's exterior styling has remained remarkably close to the concept car that was shown at the 2008 Detroit Auto Show.

According to a recent announcement from GM, the CTS Coupe's range will include a BMW M3-challenging (we doubt that it will target the more expensive M6 Coupe) "V" model boasting the same 6.2-liter supercharged V8 with 556-horsepower as the CTS-V Sedan.




VIDEO: Clever MINI Cooper S vs the Demon Carts Commercial with a Stephen King Twist

Watching this spot for the MINI Cooper S that was created by agency Butler, Shine, Stern and Partners, the first thing that came to mind was Stephen King's horror novels. The witty commercial tries to show off the crisp and go-kart-like handling of the MINI Cooper S as the driver of the car evades an army of "evil" shopping carts with minds of their own that keep attacking him in a super-market parking lot. VIDEO: 2010 Mercedes-Benz E-Class Sedan and Coupe Commercials go Live

Heralding the U.S. market launch of the all-new 2010 E-Class, Mercedes is rolling out what it calls its biggest marketing campaign in recent years. Oriented around the theme "Everything We Know, Everything We Are: This is Mercedes-Benz", the new marketing campaign comprises of both broadcast and print adverts. The first wave launches today with a six-week television flight while a second phase will start in September and run through October on primetime premieres and the NFL and college football seasons.

Aside from the 30 second plus TV adverts for both the 2010 E-Class Sedan and Coupe models that you can watch below, Mercedes-Benz has also readied three 15 second spots which focus on the car's safety technologies like Attention Assist, Lane-Keeping Assist and Distronic Plus.

The Swiss Love Bus: Bernmobil's Airport Bus Theme is a Bit Strange...

We don't know about you, but the first thing that popped into mind upon seeing Bernmobil's airport transporter was a small red bus making some kinky back-door love to a light-blue colored bus. Even though Neue Lgk, the Swiss advertising agency that came up with the idea, probably intended to show a bus 'taking off' for the airport, once you've made the abovementioned association, there's no return ticket from the state of lost innocence...

VIDEO: BMW 'Joyful' Promo Film with Some Neat Classics

The maker of 'The Ultimate Driving Machine' has released a new promotional video featuring past, current and feature production and concept bimmers such as the Z1 and Z8 roadsters, M3 E30, 2002 Convertible and the controversial 5-Series GT. As with the Z4 Roadster, the Bavarians chose to use the 'Joy' slogan in their latest film. As you can see in the video, BMW overdid it with the joy theme as everyone is smiling like a Cheshire cat on dope. And oh, for those that don't understand a word of German, no need to panic as we've added an official translation right after the jump.

New Astra Beats Ford Focus and VW Golf at Millbrook Test Track in Viral Video

Looks like General Motors' UK division is trying its hand at viral marketing with a new video showing 2010 Astra hatchback outpacing a VW Golf MKVI and a Ford Focus at the Millbrook Proving Ground test track in Bedfordshire, England. The driver behind the wheel of the Astra is none other than Vauxhall's own BTCC pilot, Fabrizio Giovanardi. If you turn up the volume and pay attention, you might hear some weird mechanical noises coming out of the Astra but guess that makes it a bit more realistic... Will be interesting to see if Ford and VW play along, but until then follow the jump to watch the video.

VIDEO: Top Gear Season 13 Trailer with Little Clarkson, Hammond, May and Stig

It's been a long break, but the boyz from Top Gear are coming back with the first episode of the thirteenth season scheduled to go on air on Sunday, June 21, 2009. In true Top Gear fashion, the creative folks over from BBC have produced a witty teaser trailer that shows Jeremy Clarkson, Richard Hammond, James May as well as the man we've all come to know as the 'Stig', in their very early years dreaming of what they want to do when they grow up. Fiat 500 Convertible "Hang's Over" at Frankfurt Airport

Following in the footsteps of other carmakers, Fiat decided to promote its newly launched 500 Convertible in Germany by hanging a full-sized model of the car on the ceiling of a main terminal at Frankfurt's Rhein-Main Airport. There are also a couple of signs on the walls that say "Happy to Meet You" though judging by the photo after the jump, people seem to be more 'happy' in finding their way out of the terminal than to stare at a car hanging over their head... The new 500 C that features a sliding ragtop with a rear-glass window went on sale in Europe this spring.

Engine options are carried over from the fixed-top 500 and include a 1.3-liter turbocharged diesel producing 75HP and two gasoline engines, a 1.2-liter four-cylinder with 69HP hp and a 1.4-liter four-pot churning out 100HP, available with either manual or robotized Dualogic transmissions.
